‘모든 사람의 평등권 실현을 위한 포괄적 차별금지법 제정을 촉구합니다’라는 제목의 성명서를 발표하였습니다.

모든 사람의 평등권 실현을 위한 포괄적 차별금지법 제정을 촉구합니다


   한국이민학회는 지난 6월 30일 국가인권위원회의 ‘평등 및 차별금지에 관한 법률’ 제정을 위한 의견표명과, 6월 29일 장혜영 의원(정의당) 등 10명의 의원이 발의한 ‘차별금지법(안)’을 지지하며, 제21대 국회는 모든 사람에 대한 차별을 금지하는 법률을 조속히 제정할 것을 촉구합니다.

   2007년 노무현 정부의 법안 발의로 시작된 차별금지법 제정 노력은 지난 13년 동안 답보상태에 머물러있었습니다. 차별을 금지하는 법률이 표현과 종교의 자유를 침해할 수도 있다는 일부의 우려와 반발 때문입니다.

   한국이민학회는 2007년 ‘국경을 넘는 인간의 이동에 따른 제반 현상에 관한 학문적 연구와 학술 활동’을 목표로 창립되었습니다. 한국이민학회 소속 연구자, 교육자, 행정가, 활동가들은 차별금지법 제정이 표류하던 동안 한국사회에 거주하는 다양한 이주민이 일상에서, 그리고 제도적으로 심각한 차별을 경험하고 있음을 목격해 왔습니다. 인종이나 국적 등에 의한 차별을 금지하는 제도적인 장치가 부재한 상황에서 이주민에 대한 차별과 혐오가 증폭되고 있습니다. 이주민을 비롯한 모든 사람에 대한 차별을 법으로 정의하고, 금지하는 것만이 상호존중과 공존을 위한 길임을 주장합니다.

   한국사회는 최근 코로나19 팬데믹 사태를 통해 사회적 소수자에 대한 차별이 개인에 대한 인권 침해일 뿐 아니라 공동체의 안전에도 위협이 된다는 사실을 인식하고 있습니다. 국민뿐만 아니라 비국민의 의료 접근성을 확대하여 생명을 지키고, 이들에 대한 무분별한 해고 및 추방을 방지함으로써 삶을 유지하는 것 또한 한국사회 구성원 모두가 노력해야 할 일임을 인식하고 있습니다. 전 지구적 위기에 대처하는 상황에서 모든 사람은 함께 협력하는 존재입니다. 모든 사람에 대한 차별금지는 개인의 인권일 뿐만 아니라 공동체를 유지하는 기본가치입니다.

   현재 차별금지법 제정에 대한 충분한 ‘사회적 합의’가 확인되고 있습니다. 세계인권선언이 발표된 지 70년이 지난 현재, 우리는 모든 사람이 성, 인종, 국적, 종교, 장애 여부 등으로 차별받지 않고 인간 존엄성과 행복을 추구할 권리를 보장받을 수 있는 사회를 염원합니다. 포괄적 차별금지법을 통해 문화적 다양성과 인권이 존중되면 한국사회에서 함께 생활하는 모든 사람의 소속감과 참여의식 또한 높아짐으로써 진정한 민주주의가 이룩될 수 있습니다.

   한국이민학회는 제21대 국회가 모든 사람의 평등권 실현을 위한 차별금지법을 반드시 제정할 것을 촉구합니다.

Statement of the Korea International Migration Studies Association (KIMSA)


We urge the legislation of the comprehensive Anti-discrimination Act for the realization of everyone’s right to equality.


   Supporting the statement of the National Human Rights Commission of Korea of 30 June on the legislation of the Act on the Equality and Prohibition of Discrimination and the bill of Act on the Prohibition of Discrimination proposed by ten members of the National Assembly including Ms. Jang Hye-young (Justice Party) on 29 June, we urge that the 21st National Assembly of Korea to legislate the law on the prohibition of discrimination against everyone as soon as possible.

   Since Roh Moo-hyun government first proposed the Anti-discrimination Act 13 years ago, its legislation has been delayed. The efforts of the legislation of Anti-discrimination have been delayed by the oppositions of certain groups that are concerned that the Anti-discrimination Act may infringe on the freedom of expression and religion.

   The Korea International Migration Studies Association was founded in 2007 with the aim of academic research and activities on all kinds of phenomena caused by human migration across borders. While the Anti-discrimination has drifted away, the researchers, educators, administrators, and activists of the Association have witnessed that migrants living in Korea have been subjected to daily as well as institutional discriminations. In the absence of the anti-discrimination measures prohibiting discrimination by race, ethnicity, nationality, etc. the discrimination and hatred against immigrants have been amplified. We argue that the critical step toward the respect and co-existence is to legislate a law prohibiting discrimination against all people including migrants. 

   Facing the Pandemic of COVID-19, everyone in Korean society realizes that discrimination against social minority groups is not only the infringement of human rights but also the threat to the safety of the community. It also recognizes the tasks of all members of Korean society are to protect lives by expanding access to medical care regardless of their nationalities, and to let the non-nationals maintain their lives by preventing reckless dismissals and deportations. Standing at the global crisis, everyone should cooperate with one another. The prohibition of discrimination against everyone is not only human rights of individuals but also the fundamental value for maintaining the community.

We affirm there is a sufficient social consensus on the enactment of Anti-Discrimination Act. Upon the history of seventy years of the Universal

   Declaration of Human Rights, we aspire to a society in which everyone’s dignity and right to pursuit happiness are respected without discrimination by gender, race, ethnicity, nationality, religion, disability, etc. By respecting cultural diversity and human rights through the comprehensive Anti-Discrimination Act, we will be able to encourage the sense of belonging and the participation of everyone living in Korean society, and thus to achieve a genuine democracy in Korea.

   The Korea International Migration Studies Association urges that the 21st National Assembly should legislate the Anti-Discrimination Act for the realization of everyone’s right to equality.
